4Be respectful to the court. Even though an expert witness’s role is to educate the court, adopting a condescending approach or manner most likely will backfire. Judges will read the expert’s report thoroughly to understand the situation, and may then ask “softball” questions to test a witness. Furthermore, a witness should not take a purely dogmatic approach to cases. Lynn said that he previously disallowed a methodology because the witness used a purely theoretical efficient market understanding without relating to the specific facts of the case.

NextGen Leadership Meeting
Forty of TMA’s up-and-coming leaders
gathered in New York City December
9-10 for the inaugural TMA NextGen
Leadership Meeting. Held at the offices
of Weil, Gotshal & Manges LLP, the
event brought together leaders of the
TMA Global NextGen program, as well
as representatives from 15 chapters.
In addition to a networking reception
and full day of strategic planning
sessions, the meeting featured a
Titans panel led by Weil’s Harvey
Miller and a business development
session presented by Alvarez & Marsal
Managing Director Stephen Wallace.
The DFW TMA NextGen group was
formed in early 2012 as part of the TMA
Dallas-Ft. Worth Chapter’s and TMA
Global’s NextGen initiative. The TMA
NextGen program provides networking,
education, and career development
opportunities and resources at both
the national and chapter levels for
those who are in the early stages
of their careers in the turnaround
and corporate renewal industry.

Mirza (Ernst & Young Capital Advisors
LLC), the purpose of the meeting was
to share best practices among chapter
leaders and develop a strategic plan for
building on the current success of the
TMA NextGen program. In just the past
1½ years, TMA has seen an increase
from 510 to 1,443 NextGen members.

mentoring, communication, and
networking opportunities for and
with young bankruptcy attorneys and
related professionals in the Dallas-Ft.
Worth area through involvement with
the bankruptcy bench, other members
of the bankruptcy and restructuring
community, and Texas law schools. J
